Refund policy

1. Introduction: two different regimes

Consumers (B2C). Natural persons purchasing for purposes outside their business, commercial, craft or professional activity. They benefit from the right of withdrawal.

Traders (B2B). Purchases made in the course of one's own activity are not covered by the legal right of withdrawal.

This document addresses consumers, except for section 9.

2. Right of withdrawal (consumers only)

Consumers have the right to withdraw from the contract within 14 days of delivery of the goods, without giving any reason and without penalty.

Where several goods ordered together are delivered separately, the period runs from delivery of the last item.

3. How to exercise the right of withdrawal

a) Online withdrawal function. You may exercise your right of withdrawal online at www.dariorasero.com/en/pages/recesso, also reachable from the footer of the site and from every order confirmation email. The function is continuously available throughout the withdrawal period and requires no account.

b) Explicit statement. Alternatively, by sending an explicit statement to info@dariorasero.com

You may use the model withdrawal form in section 10, but it is not mandatory.

4. Acknowledgement of receipt

Upon receipt of your withdrawal statement, we send you without undue delay an acknowledgement of receipt on a durable medium, containing the content of the statement transmitted and the date and time of transmission.

The right of withdrawal is deemed exercised within the period if the statement was transmitted before its expiry. Withdrawal takes effect upon transmission alone and is not subject to any approval by the Seller.

5. Returning the goods

You must return the goods within 14 days of communicating the withdrawal, to:

Please return the goods complete and, where possible, in the original packaging. You are liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods; such diminished value may be deducted from the refund. The direct costs of return are borne by you.

6. Refund

We refund all payments received, including standard delivery costs, within 14 days of the day on which we were informed of the withdrawal.

If you expressly chose a type of delivery other than the least expensive standard delivery offered, we do not refund the additional costs.

We may withhold the refund until we have received the goods back or until you have supplied evidence of having sent them back, whichever is the earlier.

The refund is made using the same means of payment used for the purchase, unless expressly agreed otherwise, and at no cost to you.

7. Exclusions from the right of withdrawal

The products offered are professional catering utensils in standard configuration: they are not made to the consumer's specifications or personalised on request, are not perishable, are not sealed for health protection or hygiene reasons, and are not by their nature inseparably mixed with other items after delivery.

No exclusion from the right of withdrawal therefore applies to the products offered.

8. Legal guarantee of conformity

All products are covered by the legal guarantee of conformity for consumers. The duration is 24 months from delivery; for consumers habitually resident in another EU Member State, the duration provided by the mandatory rules of their country of residence applies where more favourable, and in particular 3 years for consumers resident in Spain.

In the event of lack of conformity, you are entitled to have conformity restored free of charge by repair or replacement, or alternatively to a price reduction or termination of the contract. Please retain the invoice or delivery note.

The legal guarantee of conformity is independent of the right of withdrawal and applies also after the 14-day period has expired.

9. B2B purchases (traders)

Purchases by traders are not covered by the right of withdrawal, nor by the online withdrawal function referred to in section 3. Returns are accepted only with the Seller's prior written agreement. The warranty for defects under Section 7 of the Terms of Sale (Articles 1490 et seq. of the Italian Civil Code) remains unaffected.
